Offshore Partner Visa for Thai People in Australia – frequently asked questions

In what location should your Thai girlfriend be to be able to apply for a Partner (subclass 309) Visa?

Your Thai girlfriend must be in Thailand (outside Australia) at the time of application. If your Thai girlfriend is in Australia, she should consider an onshore partner visa (subclass 820).

Do you as a Sponsor to your Thai girlfriend need to be offshore as well when you apply for the 309 visa?

No, you, the Sponsor, can be either in Australia, in Thailand or anywhere in the world.

Can your Thai girlfriend be in Australia for the decision?

No, she should be in Thailand when the Department of Home Affairs (DHA) makes a decision on your Partner (subclass 309) visa application. Some limited exemptions apply.

What if you are not married to your Thai girlfriend and you haven’t lived together for 12 months?

If this is the case, you should consider a Prospective Marriage (subclass 300) visa. However, you will need to marry your Thai girlfriend within 9 months of being granted subclass 300 visa if you want to get a permanent partner visa.

What is the pathway to your Thai girlfriend Permanent Residency with this visa?

In some cases, the Department of Home Affairs (DHA) may approve the Permanent Residency stage at the same time as the subclass 309 visa. If the DHA does not, you will be able to provide further information for the Permanent Partner (subclass 100) visa exactly 2 years after your original Partner Visa lodgement by your Thai girlfriend, as long as her Partner Visa 309 has been granted.

Can your Thai girlfriend travel to Australia whilst she is awaiting a decision on a Partner (subclass 309) visa?

Yes, she can travel to Australia. However, your Thai girlfriend must be offshore when the DHA makes a decision on her application. Some exemptions apply.
